Oregon Psilocybin Mushroom Services Rules

In 2020, Oregon passed the Psilocybin Mushroom Services Program Initiative called Measure 109. The measure allows psilocybin to be administered for the treatment of mental health conditions, however, the measure also provides for this substance to be available to all those for whom it is medically indicated, which is just as critical. As psilocybin research advances for migraine and cluster headache, we need to take action to ensure that Measure 109 and other state initiatives keep true to the intent that these substances are accessible to all.

Unfortunately, Measure 109 offers restrictions that will make this substance inaccessible in ways that are necessary for those living with headache diseases, and potentially other pain conditions. As a community, engaging early and often with legislators can help to ensure that our interests are protected.

Currently, there is an open comment period for the Rules for the implementation of Measure 109. There are a few key areas where we at Clusterbusters believe that these rules could be improved to leave the door open for the future needs of all those living with pain.

These Are Our Recommended Adjustments:

Update Psilocybin Training Curriculum Modules (333-333-3060)

Section 3 H

Add a subsection that mentions education about expectations for pain treatment

Section 4 e

Include language that requires pain research be taught

Section 7 a

Add a module about psilocybin and dosing for pain

All members of the public are invited to comment on the proposed rules during the public comment period scheduled for April 1 – April 22, 2022 (closing at 5:00 p.m. PDT). We are encouraging you to comment, especially if you live in Oregon. You do not have to live in Oregon, or have cluster headache, migraine or pain to comment. During this public comment period, you can provide your comments in writing and by e-mailing publichealth.rules@dhsoha.state.or.us or by participating in one of the two virtual public hearings. Spanish interpretation, American Sign Language interpretation, and CART captioning services will be provided at the hearings.

The Oregon Psilocybin Advisory Board is only accepting comments on the draft rules released today, which are related to psilocybin products, testing and training programs. A second rulemaking process will occur for the remaining psilocybin rules later this fall.
